When you purchase a new home, you'll notice that the closing costs typically include two title insurance policies: A Lender's Title Policy and an optional Owner's Title Policy.
A Lender's Title Policy is required whenever a new mortgage is issued, and only protects the Lender's interest in the property (the loan) against problems that may arise with title, such as a legal claim against the property. The Lender's policy does NOT protect the homeowner. On a home purchase, the Lender's Title policy is a one-time cost, paid at the close of escrow, by the Buyer.
An Owner's Title Policy protects the homeowner against future lawsuits should a covered title claim arise. These types of claims may include: errors and emissions on deeds, recording mistakes, forgery or previously undisclosed heirs. An Owner's Title Policy is typically issued for an amount equal to the purchase price of the property, and covers the homeowner and their heirs, for as long as they own the property. An Owner's Title Policy is a one-time cost, paid at the close of escrow, and is paid for by the Seller or the Buyer, per the terms of the purchase contract.
Because your home is one of the largest investments you'll make, its highly recommended that you purchase an Owner's Title Policy, to protect your investment and for peace of mind.
